Sexual harassment claims remain among the most sensitive, complex, and challenging issues with which schools continue to grapple. As reported in previous editions of the School Law Advisory, the U.S. Department of Education (ED or the Department) continues to shift its expectations regarding schools’ obligations to address sexual harassment matters under Title IX. Recently, ED issued proposed sweeping changes in its Title IX regulations that, if adopted in final, will greatly alter how and when schools are to respond under Title IX when learning of sexual harassment involving students, employees, or other members of the school community.
